With just 38 days left until Election Day, Donald Trump and Mitch McConnell are preparing to stack the Supreme Court with a 6-3 conservative majority.  

If Trump's nominee is confirmed, the Supreme Court will have a nearly insurmountable super majority that would undermine generations of progress in fighting for human needs protections: voting rights, women’s rights, workers’ rights, and access to high-quality, affordable health care.

This week, the United States crossed some grim COVID-19 milestones: more than 7 million confirmed cases, and more than 200,000 Americans dead. That staggering death toll also includes more than 900 front-line health care workers in the United States.¹ These are stunning and sobering figures.  

But instead of focusing on how to prevent a second wave of COVID-19 from killing even more Americans, Trump is focused on raw power: making a lifetime appointment to the Supreme Court on a rushed, likely party-line vote.

Just one week after Election Day, the Supreme Court is set to hear a lawsuit to overturn the Affordable Care Act. A 6-3 conservative majority is a dire threat to the ACA. That means 20 million people could lose health care coverage, protections for 135 million Americans with pre-existing conditions would disappear, nearly 12 million seniors will have to pay more for prescription drugs and 2.3 million adult children will be thrown off their parents’ health insurance.

Together, we are going to unite our voices and demand the Senate wait until after Inauguration Day to confirm a replacement for Justice Ruth Bader Ginsburg―an iconic justice and the first woman and the first Jewish person in our nation's history to lie in state in the United States Capitol.²

A vote to confirm a Supreme Court justice this year is a vote to take health care away from tens of millions of people, and we are going to do all we can to prevent that.
