a constitutional amendment to prevent Court packing Protecting the Supreme Court The integrity of the Supreme Court is paramount to our society. Yet this week, as conversations surrounding the Court have grown, so have attacks on the legitimacy of the institution. Over the past week, prominent elected officials from across the country have sought to delegitimize the Court by openly endorsing a concept called “court packing.” This idea, which would upend more than 150 years of tradition by adding Justices to the Supreme Court, is nothing more than reckless partisan tactic that only undermines and politicizes this important institution. While calls to pack the Court have intensified, unfortunately, this dangerous idea is nothing new. In fact, in the past year, 11 candidates running for President expressed support or openness to the concept of Court packing, making it front and center in our political debate. As Rep. Gallagher said on Wisconsin's Afternoon News, this isn't just a bad idea, it's "one of the most disturbing trends we've seen." That's why in March of 2019 he introduced a constitutional amendment that would protect the Supreme Court by capping the number of Supreme Court justices at nine. The concept is simple: Since 1869, Congress has agreed that the proper amount of Justices on the Court is 9. Before any party tries to change this precedent for short-term gain, we need to take action to preserve this number and protect the legitimacy of the Court.
