La Rose v. Her Majesty the Queen youth plaintiffs
Dear friends,
Next week, 15 young plaintiffs in Canada will follow the lead of the Juliana 21 to defend their rights to life, liberty, security of the person and equal protection under the law pursuant to the Canadian Charter of Rights and Freedoms. Our Children’s Trust is supporting these youth, and the legal team representing them, in La Rose v. Her Majesty the Queen ([link removed]) . These brave Canadian youth are asking their courts to declare that the Canadian Charter protects their rights and to order that their government prepare a systemic and science-based climate recovery plan to do Canada’s part to bring concentrations of atmospheric CO[2] to below 350 parts per million by the year 2100.
Next Wednesday and Thursday, lawyers for the youth will appear in Federal Court in British Columbia to argue that the case should go to trial where evidence can be presented. Much like the Juliana plaintiffs, these young La Rose plaintiffs are experiencing direct and individual harms from the climate crisis that their government continues to make worse. Arguments in the case are expected to span two days. You can tune in to the arguments here ([link removed]) on Wednesday and Thursday; court should be in session each day beginning at 8:30 a.m. PDT. This Canadian case is a crucial component of Our Children’s Trust’s global climate litigation campaign on behalf of youth and future generations. We currently support related work in Mexico ([link removed]) , India, Pakistan, and Uganda, and have supported and inspired more than 15 other global cases, in addition to our work in the federal ([link removed]) and state ([link removed]) courts of the United States. This strategic multi-jurisdictional approach is necessary to protect the rights of children around the world by ensuring that governments protect the fundamental rights of children and take systemic steps to quickly reduce greenhouse gas emissions to levels that scientists say are necessary to make our climate system safe for present and future generations.
