Before the tragic death of RBG, the Supreme Court (SCOTUS) was split between right-wing conservatives and liberals/progressives, with Chief Justice Roberts a mostly conservative but sometimes liberal swing vote. If Trump/Republicans continue to pack the court by replacing Ginsburg with another extremist, the far-right will control it for years to come, and even Roberts sometimes voting with the liberals won’t help.

Trump and his Republican cronies are pushing for a quick confirmation so they will have a right-wing court to ensure partisan rulings in their favor over every election issue and challenge that arises in the November 3 balloting. This will also ensure that Obamacare and its protection for coverage of pre-existing conditions are killed when SCOTUS hears the Republican court challenge after the election.

Mitch McConnell hijacked Obama's nomination of the moderate Judge Merrick Garland by refusing even to consider it for almost a year, claiming that since 2016 was an election year, the voters needed to be heard before any SCOTUS nominee was considered. That unprecedented maneuver allowed Trump to appoint Neil Gorsuch, a fierce conservative. Now, with stunning but unsurprising hypocrisy, McConnell is abrogating the precedent he and his colleagues set in 2016 and pushing to confirm Trump's third nominee before the next Senate is elected or Biden might take office. Make no mistake, unless four Republican senators decide to do the right thing for fairness and democracy, Trump, McConnell, and the Republicans have the power to ram through another unjust, unfair, right-wing nominee and seize control of the Court for years to come.

We must do everything we can to build a political groundswell to counter the rush to confirmation and convince four Republican senators to delay confirmation until the people have had their say and the new Senate (and hopefully a new president) are installed in office.

These are going to be hard fights. The odds are against us. But we've won against long odds before, and we can do so again.

If we don't prevent the right-wing SCOTUS takeover, we should demand that the new Congress increase the number of justices on our Supreme Court to balance its perspectives. This increase can escape characterization as “court-packing” by tying it to the past practice of matching the number of Justices to the number of federal circuit courts (there are now twelve regional circuit courts of appeals).

Right now our Senators can and must use procedure to slow down the nomination of a new judge. Our demand is clear: block any nominee to the Supreme Court until after the inauguration!

The upcoming election may be the most important one of our lives—and in California, it starts in less than three weeks, with mail ballots going out on October 5. Make sure you’re ready!

Check your voter registration status today. Yes, even California purges its voter rolls, so if you haven’t voted in a few elections, you may have been removed. If you’ve moved or changed your name, your registration may be out of date. It never hurts to check.

* Elsewhere in California, use the state’s Voter Status page ([link removed][UNIQID]) .

If you aren’t registered or your registration is no longer current, you’ll need to register by October 19. We recommend you do so as early as possible–this year, we can’t afford to leave anything until the last minute. You can register to vote quickly and easily at [link removed]—do it now!

Make a plan NOW to vote. It bears repeating: this year, nothing should be left until the last minute. Because of the pandemic, all registered voters in California will receive their ballots in the mail. Fill it out, put it in the provided return envelope, sign and seal it, and return it.

You can mail in your ballot using our beloved Postal Service—the earlier the better. Every county will also have places where you can drop it off early; in San Francisco, that will be the City Hall Voting Center ([link removed][UNIQID]) (at Bill Graham Auditorium). And if you leave it until Election Day, you can drop off your ballot at your local polling place.
