In June, the Trump administration moved to gut health care protections for trans people. And now, the Trump administration is yet again going after critical protections meant to ensure the safety of trans people—in this case when they’re in need of a homeless shelter funded by the U.S. Department of Housing and Urban Development (HUD).
Help us fight back against this cruel proposal by submitting a comment now. [[link removed]] The administration is required by law to read every single comment submitted that is distinct, so make sure when submitting your comment to add personalized information like a story, statistic, or thoughts.

The Obama administration’s Equal Access Rule requires HUD-funded shelters to provide access to shelter based on someone’s gender identity, providing a critical protection from discrimination for trans people experiencing homelessness, including those seeking access to shelter to escape violence, family rejection, or natural disasters.
But Trump’s HUD is now proposing a rule that would gut the Equal Access Rule and promote sex discrimination on multiple fronts. First, the proposed rule would allow HUD-funded single-sex shelters to establish an accommodations policy based on biological sex, without regard to one’s gender identity. This would encourage widespread discrimination when trans people need help the most, when they are without a roof over their heads. Second, the proposed rule would let shelters make a “good faith” assessment of an individual’s sex based on sex stereotyping—considering physical characteristics like the presence of facial hair, height, and the presence of an Adam’s apple. This would lead to discrimination against transgender people and anyone who does not conform to the shelter’s sex stereotypes of what a woman looks like. The current Equal Access Rule provides critical safety in HUD-funded programs, and Trump’s proposed rule change would leave trans people less safe and more at risk, especially during a global health crisis and an epidemic of violence against trans people that disproportionately impacts trans women of color.
