DOJ Expands Its Beef-Price Investigation to Eight Major Retailers as Ground
Beef Stays Near Record Highs

Federal investigators are asking Walmart, Amazon, Costco, Kroger and four
other major retailers for years of pricing, purchasing and margin data as beef
remains one of the fastest-rising categories in the grocery aisle.

The Justice Department has widened its investigation into high beef prices
beyond the country's dominant meatpackers and into the retail side of the
supply chain.
Associate Attorney General Stanley Woodward sent letters dated July 14 to
Walmart, Amazon, Costco, Kroger, Albertsons, Aldi, Publix and Ahold Delhaize
USA. DOJ publicly disclosed the expanded inquiry in early September.

The letters seek information covering roughly six years of beef purchasing
and pricing activity. Investigators want to compare what retailers paid
suppliers with what consumers were charged and how retail margins changed as
cattle supplies tightened.

THE KEY DISTINCTION AN INVESTIGATION IS NOT A FINDING THAT RETAILERS
ILLEGALLY RAISED BEEF PRICES. DOJ is collecting records to determine whether
competitive problems contributed to higher prices. Tight cattle supplies
already provide a documented economic explanation for part of the increase.
The supply side is unusually tight. USDA counted 86.2 million cattle and
calves on U.S. farms at the start of 2026, including 27.6 million beef cows.
USDA has described the national herd as being near a 75-year low.
New World Screwworm also disrupted cattle flows from Mexico. USDA only began
a phased reopening of the Douglas, Arizona, port for Mexican cattle in late
August under new inspection and treatment requirements.

TWO QUESTIONS AT ONCE

SUPPLY PRESSURE FEWER CATTLE
HIGHER INPUT COSTS A historically small herd and disrupted cattle imports
limit available beef supply. COMPETITION QUESTION WHO CAPTURED
THE MARGIN? DOJ is testing whether pricing behavior at processing or retail
added further pressure.

THE PROCESSING BOTTLENECK

~85% FED-CATTLE PROCESSING FOUR LARGE PACKERS Tyson Foods, Cargill, JBS
USA and National Beef together account for roughly 85% of the fed-cattle
slaughter market.
That concentration is why federal scrutiny did not begin with grocery stores.
DOJ has already been examining the conduct of major meatpackers as part of a
broader antitrust investigation.

PRIOR LITIGATION TYSON AGREED TO AN $82.5 MILLION SETTLEMENT — WITHOUT
ADMITTING WRONGDOING. Direct purchasers had accused Tyson and other processors
of conspiring to restrict beef supply and inflate prices. The federal court
granted preliminary approval to Tyson's settlement in May.
The settlement is relevant background, but it is not a finding that Tyson
violated antitrust law and it does not establish that the eight retailers now
receiving DOJ requests engaged in illegal conduct.

THE SUPPLY-SIDE RESPONSE

300K METRIC TONS LEAN BEEF TRIMMINGS A temporary expansion of the
lower-tariff import quota is being released in three 100,000-ton tranches
through November.
The August proclamation creates a parallel policy track: while DOJ
investigates competition, the administration is also trying to increase
ground-beef supply by temporarily expanding the tariff-rate quota for imported
lean beef trimmings.

THE SIGNAL THE GOVERNMENT IS NOW TESTING BOTH SIDES OF THE PRICE EQUATION:
WHETHER BEEF IS EXPENSIVE BECAUSE SUPPLY IS TIGHT — AND WHETHER CONCENTRATION
OR PRICING PRACTICES ADDED MORE.
