Former Kosovo President Hashim Thaçi Was Convicted of War Crimes and
Sentenced to 25 Years.
Judges in The Hague found Thaçi and three other former Kosovo Liberation Army
leaders criminally responsible for arbitrary detention, cruel treatment,
torture and murder during and after the 1998–1999 Kosovo conflict.

Nearly six years after Hashim Thaçi entered detention in The Hague, judges
have delivered the first trial judgment against the former Kosovo president and
three other senior figures from the Kosovo Liberation Army.
The Kosovo Specialist Chambers found Thaçi, Kadri Veseli, Rexhep Selimi and
Jakup Krasniqi individually criminally responsible for war crimes committed
against people perceived as opponents of the KLA's political and military
objectives.

The Trial Panel found that the four defendants were responsible for arbitrary
detention involving 385 people, cruel treatment involving 49 people, torture
involving 303 people and the murder of 96 people.
The victims included Kosovo Albanians associated with competing political or
military groups, people alleged to have links with Serbian or Yugoslav
authorities, and members of minority communities, including Roma and Serbs.
IMPORTANT LEGAL DISTINCTION GUILTY OF WAR CRIMES. NOT GUILTY OF CRIMES
AGAINST HUMANITY. Judges concluded that prosecutors had not proved beyond a
reasonable doubt that the crimes formed part of a widespread or systematic
attack directed against a civilian population.
That acquittal is an important part of the judgment. The defendants had faced
six crimes-against-humanity counts in addition to the war-crimes allegations,
and the court also acquitted them in relation to several specific alleged
war-crime incidents.

The court did not simply hold Thaçi liable because of his title. Judges found
that he and the other defendants made significant contributions to a common
criminal purpose aimed at people regarded as opponents of the KLA's political
or military objectives.
The judgment therefore concerns individual criminal responsibility rather
than a legal judgment on the KLA as an organization or on Kosovo's independence
struggle as a whole.

Thaçi and Krasniqi received 25-year sentences, Veseli received 18 years and
Selimi received 13. The court ordered that time already spent in detention be
credited toward the sentences.

Thaçi was the KLA's political leader during the conflict and later became one
of the dominant figures in postwar Kosovo. As prime minister, he was a central
political figure when Kosovo declared independence in February 2008.
He was elected president in 2016 and served until November 2020, when he
resigned after the Specialist Chambers confirmed the indictment and traveled to
The Hague to face the charges.

The judgment sits inside a conflict with several layers. The KLA fought
Serbian and Yugoslav forces during a period in which large numbers of ethnic
Albanian civilians were displaced and subjected to violence. NATO intervened
militarily in 1999, and Serbian forces later withdrew from Kosovo.
The Specialist Chambers' case does not erase that history. Its narrower
question was whether the four defendants were individually responsible for
crimes committed against particular people during the same period.
REACTION IN KOSOVO THE VERDICT HAS BEEN MET WITH PROTESTS AND SHARP
POLITICAL DISAGREEMENT. Thaçi remains closely associated with Kosovo's
independence movement, and supporters have rejected the judgment. The court and
prosecutors emphasize that the case concerns the criminal responsibility of
individuals rather than the legitimacy of the KLA or Kosovo's independence.
THE LEGAL LINE THE COURT DID NOT PUT THE KLA OR KOSOVO'S INDEPENDENCE ON
TRIAL. IT RULED ON THE INDIVIDUAL CRIMINAL RESPONSIBILITY OF FOUR FORMER KLA
