Precious Life welcomes Legal Challenge
to Belfast City Hall abortion illumination

Precious Life has welcomed a legal challenge to Belfast City Council’s decision to illuminate Belfast City Hall in celebration of abortion on 28th September.

The legal challenge has been brought by a long-standing Belfast pro-life campaigner with more than 25 years of experience supporting women in crisis pregnancies and their unborn babies.

The Pre-Action Protocol Letter argues that City Hall is a major civic symbol belonging to the whole community, and that the Council should not use it to publicly endorse one side of a deeply contested moral, religious and political debate without properly considering the rights and interests of those who hold pro-life beliefs.

The Pre-Action Protocol Letter raises serious questions about the Council’s decision-making process, including:

- Equality and good relations: whether the Council properly considered its duties under Section 75 of the Northern Ireland Act 1998, including the impact on people holding particular religious beliefs and political opinions.

- Civic neutrality and inclusion: whether using Belfast City Hall to promote an abortion campaign properly respects citizens who sincerely believe that unborn human life deserves protection.

- The Council’s own illumination criteria: whether the published criteria were properly applied and, if the Council departed from them, whether there were properly identified and justified exceptional circumstances.

- Human rights: whether sufficient consideration was given to the rights to freedom of conscience, religion, expression and association under Articles 9, 10 and 11 of the European Convention on Human Rights.

- Transparency: the campaigner is seeking disclosure of the relevant minutes, applications, correspondence, legal advice, equality assessments, good-relations assessments, briefing papers, voting records and the reasons for the decision.

Director of Precious Life, Bernadette Smyth, said, “This legal challenge is not based simply on the fact that abortion is controversial. The central issue is whether Belfast City Council properly considered its legal duties and the interests of the whole civic community before using one of Belfast’s most prominent public symbols to support a particular abortion campaign.”

She added, “This challenge is seeking the suspension and withdrawal of the proposed illumination, or alternatively a lawful reconsideration of the decision following proper equality, human-rights and good-relations assessment. If the Council does not provide a satisfactory response, the campaigner intends to proceed by way of judicial review in the High Court.”

Bernadette Smyth concluded, “We welcome this important challenge. Belfast City Hall belongs to everyone. Those who believe in the protection of unborn babies should not be treated as though their rights and concerns don’t exist.”
