This year, America marks 25 years since 19 jihadists murdered nearly 3,000 of our countrymen and women on September 11, 2001. And the man who planned it is still alive, still fed, and still housed at Guantanamo Bay on the American taxpayer’s dime.

Khalid Sheikh Mohammed confessed in his own 2007 tribunal transcript [ [link removed] ] that he was “responsible for the 9/11 operation from A to Z.” However, Air Force Lt. Col. Michael Schrama, who serves as the Judge in KSM’s case, just threw out the confession [ [link removed] ], saying it was coerced and that KSM had not been read his Miranda Rights. Government prosecutors can appeal the ruling, and I hope they do.
Judge Schrama has a history of siding against conservatives, calling into question his ability to be impartial in KSM’s case. In 2023, Schrama argued that members of the military were susceptible to recruitment by “extreme right-wing groups.” The White House called [ [link removed] ] Schrama’s decision to toss KSM’s confession a “disgrace” and an “outrage.”
KSM has been in U.S. custody since 2003 and at Gitmo since 2006. He has never stood trial or been sentenced. Now, finally, a trial date has been set for 2028 [ [link removed] ], but anything could happen between now and then, and the trial could still get delayed.
Why hasn’t KSM already received the death penalty for his heinous acts?
Recently, I traveled to Guantanamo Bay with the Pentagon Press Corps and Secretary of War Pete Hegseth. When we flew back to Tampa for a visit at CENTCOM headquarters, I asked Secretary Hegseth directly why our government has kept KSM and the other Islamic jihadists behind 9/11 alive and comfortable at Gitmo for decades instead of executing them and delivering justice for their victims.
Hegseth didn’t dodge the question, saying:
“These Gitmo detainees should have been executed, in my mind, personally, a long time ago.”
Secretary Hegseth is right.
Only 15 Islamic terrorists remain at Guantanamo Bay today out of the nearly 780 who have passed through the base since 2002. Of those 15, only three have even been cleared for transfer. The rest, including KSM and his co-conspirators, remain tangled in a military commissions process that has dragged on for more than 15 years.
During his 2008 campaign for President, Barack Hussein Obama promised to close Gitmo, but that never happened. I guess it’s unsurprising from the man who couldn’t even bring himself to call those who murder in the name of Allah “Islamic terrorists” and who went to Middle Eastern countries on an apology tour soon after assuming office.
In 2024, the Biden Pentagon tried to let KSM and two of his co-defendants plead guilty in exchange for life sentences, taking the death penalty off the table entirely for the men who murdered thousands of Americans in the name of Islam. Then, after national outrage and condemnation from the American public, then Defense Secretary Lloyd Austin killed the deal days later. A federal appeals court upheld his decision this past summer [ [link removed] ], clearing the path for prosecutors to keep pursuing the death penalty. Pretrial hearings dragged on again as recently as this past May. [ [link removed] ]
Yet here we are, 25 years later, and nobody has been convicted, sentenced, or executed, while the lawyers who built their careers defending these terrorists just keep getting more powerful.
Islamic communist New York City Mayor Zohran Mamdani’s handpicked chief counsel [ [link removed] ], the top legal officer for the largest city in America, is a man named Ramzi Kassem. Kassem spent his career defending accused and convicted al-Qaeda terrorists held at Guantanamo Bay and Bagram Air Base, including Shaker Aamer, who fought alongside al-Qaeda at the Battle of Tora Bora and has been described as a “close associate” of Osama bin Laden [ [link removed] ]. Kassem also served as lead counsel for Ahmed al-Darbi, an al-Qaeda operative convicted by a U.S. military commission for his role in the 2002 bombing of the French oil tanker Limburg. Bombing oil tankers has been a staple tactic of jihadists for decades, which is seen in the terrorist activities of the IRGC and the Houthis today.
Kassem has said himself that “9/11 happened and of course that changed everything.” [ [link removed] ] Now Kassem runs the legal department of New York City just a stone’s throw from where the Twin Towers were brought down by Islamic terrorists.
Kassem is reportedly dating Darializa Avila Chevalier [ [link removed] ], the Mamdani-backed communist on track for Congress. According to Chevalier’s own account, their romantic relationship began through their shared work freeing immigration detainees. Mamdani’s office has confirmed the mayor knew about the relationship before he endorsed her campaign.
The Democrat party is elevating candidates who won’t condemn Islamic terrorism, and people who openly glorify Islamic terrorism. It is elevating people who built their careers keeping jihadis out of a courtroom conviction. And they’re all campaigning with Hasan Piker, the Islamic communist streamer who said America deserved 9/11 and who has a framed copy of the newspaper from 9/12/01, the day after 9/11 hanging in his studio so he can celebrate and glorify the attack on our country. Whenever Democrats get a tough question about Piker, they demur: “He has an audience” they say, or “Why are you picking on Hasan?” according to Rep. Rashida Tlaib.
The families of nearly 3,000 murdered Americans deserve the justice they’ve waited 25 years for before this anniversary passes with these monsters still breathing. As each day passes, more Americans get diagnosed with cancer and many have since passed away from the illnesses they developed as a result of the Islamic terror attack their bodies were subjected to 25 years ago. It will continue to be a stain on our nation with each day that passes in which an innocent American dies from a 9/11 illness while KSM is fed and taken of at a US military base as opposed to facing the firing squad with 2,977 bullets in honor of each 9/11 victim.
