Sitting NC Supreme Court justice Phil Berger, Jr. announced that he will not seek re-election as an Associate Justice in 2028.

Court watchers and state experts have pointed out that Berger may be leaving his post as Associate justice to prepare for a possible run for Chief Justice, if the current Republican Chief Justice Newby chooses to retire. 

The outlook for flipping this state supreme court in 2028 during the presidential election has been shaken up, with a potentially huge advantage for Democrats.

Berger’s move has huge implications for Democrats’ do-or-die mission to flip this swing state supreme court in the 2028 presidential year: 

• Berger’s seat will now be open and the path to flipping it, and the court itself, in 2028 now looks wide open



• But, should Berger decide to run for chief justice, he will start with an advantage that will be hard to overcome for Dems
