Missouri's Map Fight Produced Two Conflicting Court Orders. The Supreme Court
Has Now Stayed the Federal Order.

Justice Brett Kavanaugh first declined Missouri's request to block a
state-court ruling requiring the 2022 congressional map. Minutes later, a
federal judge ordered the opposite result. Two days later, the full Supreme
Court stepped in and stayed that federal order.

MISSOURI SUPREME COURT 2022 congressional map State court said the 2025
districts never took effect after a referendum petition was filed. VS FEDERAL
DISTRICT COURT 2025 HB 1 map Judge Stephen Clark temporarily barred
officials from using any other map.

OPERATIVE FOR NOW
Missouri's congressional redistricting fight produced an extraordinary
sequence of conflicting court orders this week. The Missouri Supreme Court had
unanimously ruled that the state's 2025 congressional districts never became
effective after opponents submitted a referendum petition challenging them. The
court ordered Secretary of State Denny Hoskins to place the referendum on the
November ballot and directed the state to use its 2022 congressional districts
for the general election.
Missouri officials then asked the U.S. Supreme Court to stay that ruling.
Justice Brett Kavanaugh, who handles emergency applications from the Eighth
Circuit, denied the request without explanation on September 8. His order left
the Missouri Supreme Court judgment in place, but it did not resolve a separate
federal lawsuit challenging the use of the older districts.

HOW THE ORDERS COLLIDED
SEP 03 Missouri Supreme Court directs officials to use the 2022
congressional map and places the referendum on the November ballot.

SEP 08 Kavanaugh declines Missouri officials' emergency request to stay the
state Supreme Court ruling.

MINUTES
LATER U.S. District Judge Stephen Clark issues a 14-day temporary restraining
order barring use of any congressional map other than the 2025 HB 1 map.

SEP 09 The Eighth Circuit declines to immediately block Clark's order,
sending the dispute back to the U.S. Supreme Court.

SEP 10 Kavanaugh refers the new stay request to the full Supreme Court,
which grants it and pauses the federal district court order while the appeal
proceeds.
The conflicting orders arose from separate cases and separate legal theories.
The state litigation focused on Missouri's constitutional referendum process.
Redistricting opponents collected hundreds of thousands of signatures seeking a
statewide vote on the legislature's 2025 map, and the Missouri Supreme Court
concluded that filing the referendum petition suspended the new districts
before they became operative.

Election administration Whether changing maps after the primary violates
federal election rights or requirements.
The separate federal case argued that reverting to the 2022 districts after
Missouri had already conducted its August primary under the newer map could
violate federal rights. Judge Clark agreed that the plaintiffs faced potential
irreparable harm and temporarily blocked use of any map other than HB 1. That
left election officials facing two court directives pointing toward different
district lines until the Supreme Court intervened.

AUGUST PRIMARY ~1.2M Missourians voted under the newer districts GENERAL
ELECTION 2022 LINES Those are the lines currently restored by the state-court
ruling.
The dispute has particular consequences for Missouri's Kansas City-based 5th
Congressional District, represented by Democrat Emanuel Cleaver. The
Republican-led legislature's 2025 map divided Kansas City differently and was
designed to make another congressional seat more favorable to Republican
candidates. Republicans currently hold six of Missouri's eight U.S. House seats.

For now, the Supreme Court's September 10 stay removes the immediate conflict
created by Clark's temporary order. The federal litigation itself is not
finished: the stay remains in place while the Eighth Circuit considers the
appeal and potentially while a later petition reaches the Supreme Court. The
referendum on the legislature's new congressional districts remains part of
Missouri's November election.

03 CORE NOTES Three points in the Missouri map fight

01 Kavanaugh's September 8 denial contained no explanation and left the
Missouri Supreme Court judgment intact, but it did not resolve the separate
federal lawsuit that produced Judge Clark's temporary order.

02 The full Supreme Court has now stayed the federal district court's order,
removing the immediate requirement to use the 2025 HB 1 map while the federal
appeal continues.

03 The November referendum and the federal appeal remain separate unresolved
parts of the dispute, so the litigation over Missouri's 2025 districts
continues even though the immediate 2026 map conflict has been paused.
