There is a development in the Colorado preschool case that I do not want you to miss.

The United States government has filed a brief supporting the Christian families and preschools.

The government’s attorneys at the Department of Justice told the Supreme Court that Colorado is forcing Catholic preschools to choose between remaining faithful to their beliefs and receiving a public benefit available to nearly 2,000 other schools.

They concluded that Colorado's law "cannot pass muster" under the Constitution, and asked the Supreme Court to reverse the lower court's ruling.

Colorado is still defending its power to withhold public benefits from Christian schools unless they comply with the state’s agenda on marriage, gender, and family. The Justices will now weigh Colorado's arguments against the voices of every family watching this case, including yours.

Now the date has been set.

That gives Americans a clear window in which to speak up about what is at stake.

If the government of Colorado succeeds, other states will use the same tactic wherever Christian beliefs collide with government conditions.

Dan and Lisa Sheley are raising seven children. Like millions of Christian parents across America, they want what their children learn at school to support the faith and values they teach at home.

So when Colorado promised families 15 hours of free preschool each week, Dan and Lisa chose the preschool they trusted: their local parish school.

Their children would be taught by people they knew, in a place that shared their Catholic faith. It should have been a simple choice.

Colorado’s universal preschool program directs public funds to nearly 2,000 public and private preschools. The state has approved 17 special enrollment preferences and has said additional preferences could include preschools serving gender-nonconforming children.

Yet when Catholic preschools asked for an accommodation that would allow them to participate without abandoning their beliefs about marriage, sexuality, gender, and family, Colorado refused.

The benefit is worth about $6,000 per child. Dan and Lisa pay taxes like every other Colorado family, but they must pay thousands more because the preschool they trust refuses to surrender its faith.

If Colorado can do this to Dan and Lisa, another state could do it to your family.

The Supreme Court has agreed to hear the case and has scheduled oral arguments for November 3.

The question before the Justices is whether a state can offer public benefits to families while refusing to accommodate religious schools that cannot comply with the state’s demands without violating their faith.

Colorado argues that Catholic preschools are free to participate as long as they comply with the state’s requirements. But those conditions would prevent parish preschools from making enrollment decisions consistent with Catholic teaching on marriage, sexuality, gender, and family.

If Colorado succeeds, other states will know exactly what to do. They can create attractive public programs and attach conditions that force families to choose between their faith and the benefits their taxes fund.

The same tactic could spread to school choice, childcare, foster care, adoption, and ministries that serve the public.

This case will help determine whether religious freedom still protects Christians when they step outside their homes and churches to educate children and serve their communities.

The First Amendment does not allow a state to punish Americans for the free exercise of their religion.

Colorado cannot use a public benefit to force Christian families and schools to embrace the state’s agenda about gender, marriage, and family - and it cannot offer exceptions to favored groups while denying Christians an accommodation for their faith.

The Supreme Court has already ruled that states cannot exclude religious institutions from public benefits simply because they are religious. Colorado is trying to get around those decisions by calling its demands neutral “conditions” that apply to everyone.

But there is nothing neutral about telling a Catholic school that it may receive public funding only after it agrees to act against its Catholic beliefs.

The government cannot make religious surrender the price of equal treatment. It cannot use tax-funded programs to drive Christian families toward schools that teach the state’s ideology while making a faithful education more expensive.

The Supreme Court will hear oral arguments on November 3. The time for you to be counted is now, before the Justices hear the case and decide whether Colorado may make religious surrender the price of equal treatment.
