John, Earlier this week, the Supreme Court allowed the Trump admin to move forward with its attempt to effectively ban mail-in ballots in blue states. The far-right Roberts Court used the "shadow docket" to hand down this ruling. No signed opinion. No reasoning to scrutinize. No oral arguments. Just a 6-3 order along ideological lines that will cause mass chaos and confusion this November. The Court did not even rule on whether the new USPS rule is legal. Instead, they ruled on a technicality, claiming the blue states who challenged the rule sued too early, before it was finalized. That final rule dropped Friday night, just days before the Court's ruling. Mail-in ballots start going out in less than a month in some states. This ruling forces blue states into a corner: comply, hand over your voter data, and risk that data being used by Trump to challenge election results if the Court later strikes the rule down, or wait and risk sending ballots late or even losing the ability to send ballots at all if the Court upholds it. The Supreme Court is now working hand-in-hand with Trump to cause chaos this November. Earlier this year, they gutted the Voting Rights Act, a decision that let red states move to eliminate Black congressional districts, delay ongoing primaries, and hand Republicans more than a dozen seats. That’s what makes this ruling so disturbing. Whether or not SCOTUS ultimately rules in favor of allowing Trump to effectively ban mail-in ballots in blue states, the damage is already done. It means Democrats are not just fighting off election rigging threats from federal agencies like the DOJ, DHS, and USPS, but the highest court in the land too.
