Less than 48 hours after a Supreme Court ruling opened the door to Trump’s attempt to make it harder to vote, I filed a new lawsuit to protect mail-in voting ahead of the midterm elections.

First, Trump issued an illegal Executive Order that directed the USPS to send mail-in ballots only to voters on a list of eligible mail voters provided by the states.

Then , the USPS adopted an illegal rule to implement that order and compile a list of enrolled mail voters.

Now , under the current USPS rules, if an eligible voter isn’t on the federal government’s official voter list, or if a ballot doesn’t meet specific new requirements, USPS can refuse to deliver a ballot to an eligible voter.

Let me clear: it is against the law for USPS to discriminate among users of the mail and reject mail. The Constitution gives states — not the Postal Service or the President — the authority to regulate elections, period. So I’ve filed a lawsuit — my 86th against the Trump administration since he was inaugurated last year — challenging this unlawful USPS rule that restricts voting.

The right to vote is what our nation was founded on, and it is the cornerstone of a functioning democracy. Now, Donald Trump is so terrified of losing the midterms that he is taking unprecedented measures to restrict that right and interfere with our elections — but this fight is far from over.

The facts and the law are on our side, and we will never stop fighting to protect the constitutional right to vote for every single Californian and American.
