British Columbia is facing a property rights crisis – and without action, this crisis risks undermining Canada’s tradition of protecting private property.
A new essay series, written by prominent legal scholars and academics, outlines three potential solutions to address the uncertainty caused by Indigenous title-induced property rights challenges in B.C.:

Use Existing Constitutional Provision: Use section 43 of the Constitution (which allows amendments affecting only one province) to clarify how Aboriginal title and private property rights interact in B.C.

Recommit and Improve the Treaty Process: Focus on clear, transparent treaties to define Aboriginal rights and avoid future conflicts.

Repeal Section 35: Revisit the Charter of Rights and Freedoms and remove sections that treat Indigenous people differently from other Canadians.
