We won our 32nd case against the Trump administration! The president made the unlawful decision to roll back penalties for automakers that fail to meet fuel efficiency standards.
President Trump’s attempt to illegally slash the penalty to less than half its previous level encourages manufacturers to accept the financial hit instead of complying with critical fuel efficiency standards. In other words, this gives manufacturers the wrong incentives. It’s better for their pocketbook to pay the penalty rather than invest in a clean solution.
Three judges (coincidently all appointed by Donald Trump) agreed with our position and overturned the Trump administration’s penalty cuts.
