Federal Judge Dismisses Trump's Antisemitism Lawsuit Against Harvard — Calls
Evidence "Too Isolated and Episodic"




A federal judge in Boston dismissed the Trump administration's civil rights
lawsuit against Harvard University, delivering a significant legal setback to
the administration's ongoing pressure campaign against the country's most
prominent research university. U.S. District Judge Richard G. Stearns — a
Clinton appointee serving on the Massachusetts federal bench — found that the
government had failed to demonstrate an ongoing violation of Title VI of the
1964 Civil Rights Act, which prohibits discrimination based on race, color, or
national origin in federally funded programs. "Without diminishing any concern
arising from these occurrences, the court finds them, singly and collectively,
to be too isolated and episodic to support a plausible inference that any

The lawsuit, filed in March, alleged that Harvard faculty and leadership
"turned a blind eye to antisemitism and discrimination against Jews and
Israelis" following the October 7, 2023 Hamas attacks on Israel and the campus
protests that erupted in response. Government attorneys argued that incidents
on Harvard's campus — including protests, encampments, and confrontations
between students — amounted to a hostile environment that Harvard failed to
adequately address. But Judge Stearns found the evidence presented focused
overwhelmingly on incidents from the 2023-24 academic year, with only a handful
of additional incidents from early 2025 — a timeframe the judge found
insufficient to establish the kind of "persistent" violation that would justify
the sweeping institutional remedies the government sought.

The Justice Department's Civil Rights Division announced it would appeal the
decision. Assistant Attorney General Harmeet Dhillon said DOJ "disagrees with
the ruling and is assessing next steps," adding that the department is actively
investigating antisemitism at universities nationwide. Whether the appeal will
fare better than the initial lawsuit before a higher court depends on whether a
circuit court panel reads the evidence of campus antisemitism differently than
Judge Stearns — or whether the administration can present new evidence of
post-2025 incidents that creates the "ongoing violation" the lower court found
absent.
