I am not going to dress this up. On June 29 the Supreme Court held that
federal law does not require mail ballots to be received by Election Day.
Mississippi may keep counting ballots that arrive up to five business days
late. We lost that case.

Four justices saw it his way. Five did not. That is how this works, and the
ruling stands. But it decided one question only: what federal law requires. It
did not touch who writes these deadlines in the first place.


The Constitution hands the time, place, and manner of elections to the states.
Roughly 30 states currently count absentee ballots that arrive after Election
Day — and every one of those windows was written in a state legislature. Which
means every one of them can be rewritten there.
