It’s been six years since the government pulled the rug out from under Tom Rost.
Tom is the owner of the award-winning R.G. & G.R. Harris Funeral Homes in Michigan. The 100-year-old business has been passed down through five generations of Tom’s family. But Tom has been caught up in the middle of a legal firestorm because unelected government officials and judges are trying to bypass Congress and rewrite the law.
Now, the future of Tom’s business—and his family’s legacy—is being threatened. He needs your help.
Tom was targeted for relying on the law
Harris Funeral Homes has a sex-specific dress code as part of its professional codes of conduct. It helps ensure that families can focus on the grieving process rather than the funeral home or its staff.
The dress code is consistent with industry standard and federal law. Every employee agrees to follow the dress code upon being hired.
But one day, a male funeral director handed Tom a letter. The letter informed Tom that after nearly six years of employment, this employee planned to begin dressing and presenting as a woman while working with the grieving families Harris Funeral Homes serves.
Tom was surprised. He cared about this employee, as he does all of his employees. He took two weeks to think and pray about the situation.
Ultimately, Tom decided that he could not go along with the employee’s plan to violate the dress code, so he tried to resolve things amicably.
But the employee filed a complaint against Tom with the Equal Employment Opportunity Commission. The EEOC then sued Tom and Harris Funeral Homes for sex discrimination.
It didn’t matter that Tom’s sex-specific dress code was consistent with federal law. The EEOC believed that “sex” should mean “gender identity” in federal employment law, and it imposed this view on Tom in its efforts to punish him.
Because the federal government has attempted to change the law out from under Tom, he and his family have suffered a great injustice.

Only Congress has the authority to make the law
In America, Congress writes the law. It says so in our Constitution. That power does not belong to unelected bureaucrats or judges.
Although the EEOC originally set out to rewrite the law through this case, the good news is that the federal government has since changed its position and now agrees with Tom that “sex” in federal employment law refers to biological sex.
The bad news is that the ACLU is now involved and sees this as an opportunity to rewrite the law to accomplish a change that it could not achieve through Congress.
Now, Tom’s case is before the United States Supreme Court. Oral arguments will take place on October 8.
If the Supreme Court rules against Tom, he isn’t the only one who will suffer. This case is about much more than sex-specific dress codes at your local funeral home.
Changing the definition of sex will have widespread consequences for business owners like Tom, and it will threaten equal opportunities and bodily privacy for women and girls.
Even worse, it could mean giving a free pass to those who want to use the courts to change the laws that Congress enacts.
If unelected bureaucrats and judges can change the meaning of a law enacted by Congress, there is no stopping them.
