WASHINGTON, D.C. – America First Legal (AFL) has launched an investigation into what New Jersey officials have described as a “software glitch” that resulted in roughly 6,600 aliens being registered to vote in American elections. AFL filed a formal Open Public Records Act request with the New Jersey Department of State, Division of Elections, seeking records related to the processing of alien voter registrations transmitted by the Motor Vehicle Commission between June 2023 and June 2024.
According to New Jersey officials, the “software glitch” resulted not only in thousands of alien registrations but also in around 400 ballots being cast. AFL is demanding that New Jersey state officials reveal how these registrations occurred, who was responsible, and how state officials responded after the issue became public.
The request seeks records showing whether noncitizen applicants answered “no” to the citizenship question, their countries of citizenship, the elections in which any ballots were cast, and whether any race was decided by a margin smaller than the number of ballots unlawfully cast.
AFL is also seeking communications with technology vendor IDEMIA, system logs, citizenship indicators, contracts, quality-control testing, internal discussions about the cause of the registrations, and records detailing any steps taken to remove ineligible voters or prevent further failures before the 2026 general election.
New Jersey election officials have reportedly blamed the alien registrations on a vendor error, while IDEMIA has attributed responsibility to the state. AFL’s request targets that dispute.
AFL’s request also seeks notices provided to aliens who may have been led to believe they were eligible to vote, as well as any proposed administrative, technological, contractual, or legislative changes intended to prevent additional ineligible registrations.
“One alien registering to vote is one too many. One error in New Jersey improperly registered thousands of noncitizens — and hundreds cast ballots,” said Will Scolinos, Attorney at America First Legal. “American elections can only be called ‘safe and secure’ when zero aliens are canceling American votes.”
