Senator Pauline Hanson has circulated legislation she plans to have introduced to Parliament aimed at preventing the return of people who leave Australia to fight with terrorists overseas.
The Protecting Australians from Foreign Terrorist Fighters Bill 2026 will not only keep Australians safer. It demonstrates the measures the Albanese Labor and Morrison Coalition governments could have taken to prevent any ISIS terrorist from returning…but didn’t.
Apart from moral bankruptcy – or political cowardice in the face of a potential backlash from Muslims who support Islamic terrorism – there's no other explanation for the reluctance of Albanese and Morrison to stop these despicable people from coming back to Australia. One Nation’s new legislation shows they could have done it if they truly cared about the safety of the Australian community.
One Nation’s legislation amends the Counter-Terrorism (Temporary Exclusion Orders) Act 2019 to add a new court-based order: the foreign terrorist fighter exclusion order, allowing the responsible minister to apply for such an order to the Federal Court which – if successful – suspends any obligation on the minister to issue a return permit.
The legislation amends the Crimes Act 1914 to provide that a bail authority (usually a magistrate or a judge) can’t grant bail to someone charged or convicted or a terrorism offence, and that bail authorities must treat protection of the community and national security as paramount considerations. It also amends the Australian Passports Act 2005, conferring power on the responsible minister to refuse to issue Australian travel documents to someone charged or convicted of a terrorism offence or someone under a temporary exclusion order or foreign terrorist fighter exclusion order.
Finally, the legislation inserts a new section in the Criminal Code, making it an offence to organise or facilitate the entry into Australia of people who have engaged in terrorism-related conduct unless it’s by or on behalf of a Commonwealth authority or with the written permission of the Minister for Foreign Affairs and the Minister for Home Affairs.
One Nation will introduce the legislation when Parliament resumes and is calling on every senator and MP to support it. Those who do support it will be demonstrating they prioritise community safety and national security. Those who don’t support it will show their priorities lie elsewhere…and that they’re unfit as legislators. The first priority of any government or elected representative must be the safety and security of Australia and its people.
