WILL WINS Act 10 Case

WILL secured a significant victory at the Wisconsin Court of Appeals after they upheld Act 10 in Abbotsford Education Association v. WERC.

WILL represented a teacher who supported and benefited from the law signed by Governor Scott Walker in 2011.

This case was originally brought in Dane County Circuit Court, which found that Act 10’s classifications of certain employees violated the Wisconsin Constitution’s guarantee of equal protection and based on that, declared nearly all of the law unconstitutional.



Lucas Vebber, WILL Deputy Counsel, stated, “WILL has fought to protect Act 10 since its enactment because of the substantial benefits provided to taxpayers and local governments. For 15 years, various legal challenges have been unsuccessful, because ultimately this is a law signed by the Governor and passed by a duly elected legislature which meets all constitutional requirements."

WILL Secures Election Integrity WIN

In a separate case, a judge sided with WILL ruling against an effort to allow 91,000+ Wisconsinites who already voted in the August Primary Election to revote. The lawsuit followed Sara Rodriguez’s departure from the Democrat Primary for Governor.

WILL’s legal effort has everything to do with protecting the letter of the law and illustrating the dangers in haphazardly allowing potentially tens of thousands of Wisconsinites to re-vote within days of the August 11 primary.

Challenging Race-Based Scholarships

WILL filed a new lawsuit challenging at least 20 UW-Madison scholarships and grants that contain race-based criteria and are administered with support from taxpayer funds.

WILL represents Young America’s Foundation and Citizens Defending Liberty in our second lawsuit challenging race-based state programs since winning a major case at the Wisconsin Supreme Court earlier this year, in which a unanimous Court struck down a racially discriminatory scholarship program.

Resetting the Message: A Roadmap to Re-Engaging Populist Conservatives

In partnership with Heart+Mind Strategies, WILL released “Bridging the Gap,” new public opinion research exploring how populist-leaning conservative voters in Wisconsin view government institutions, as well as ways to reconnect classical conservative principles like federalism, free markets, and trust institutions with values this key audience already holds.

By the Numbers:

• Cost of living and the economy are the top issues, named far ahead of any other concern with 24% of respondents naming inflation as their top issue and another 24% naming the economy
• 98% say addressing corruption and transparency in government is important
• 90% support more government audits
• 67% say real accountability requires checks and balances, not unilateral authority
• Confidence in fair national elections rises from 64% to 84% when tied to specific safeguards
• 85% are confident their local elections are conducted fairly
• 91% say you can disagree with someone and still respect them

How Economic Pain Can Drives Voters Towards Price Controls: This audience’s biggest break with free-market conservatism is on price controls. This audience is genuinely split on government intervention in prices. There is meaningful support for government caps on prescription drugs (59%), energy/utility rates (56%) and credit card interest rates (45%). This is an important populist divergence from what traditional free-market conservatives traditionally support.

As part of the survey, WILL also took these findings to develop a messaging toolkit for policymakers and communicators to use to reinforce these principles.
