Here’s what’s going on right now in our fight to protect mifepristone access:
→ At the end of last year, the state of Louisiana sued the FDA to try to block this safe, legal medication from being prescribed by telehealth and delivered by mail.
→ After months of back and forth, the U.S. Supreme Court ruled in May to allow continued access to mifepristone nationwide while the case proceeds.
Now the case has returned to the U.S. Court of Appeals for the Fifth Circuit for a merits determination — a ruling on the actual substance of Louisiana’s claim — and I joined a coalition of 23 attorneys general in filing an amicus brief urging the court to issue a final ruling that protects lawful access to mifepristone.
Louisiana’s lawsuit attempts to reinstate a medically unnecessary requirement that mifepristone be dispensed in person — going against decades of scientific evidence.
Reinstating this requirement would create administrative chaos across the country, undermine states’ ability to protect access to reproductive care, and, critically, it would make it more difficult for individuals, especially in rural, low-income, and underserved communities, to access reproductive health care.
Bottom line: mifepristone is a safe, effective, and often lifesaving medication, and attempts to limit access to it are driven by a right-wing, anti-science political movement that’s determined to chip away at reproductive freedom and bodily autonomy nationwide.
