Another Win for EMT Students Religious Rights
Protecting Religious Beliefs in Clinical Placements!

Healthcare students are often told they have only two choices: receive the required vaccines or abandon their chosen career. Schools frequently claim that hospitals, ambulance providers, and other clinical partners will not accept students with religious accommodations. But AVFCA continues to prove that is not always the case.

A Voice for Choice Advocacy is pleased to share another success story.

Tino, a student enrolled in an Emergency Medical Technician (EMT) program at a public California community college, had met every program requirement except receiving a Tdap vaccine, which conflicted with his sincerely held religious beliefs. While California law does not require vaccinations for students attending community colleges, completion of the EMT program required a clinical ambulance ride-along with an outside healthcare provider. When Tino requested a religious accommodation, the college told him it could not approve one because students had to meet the vaccination requirements of its clinical partners.

AVFCA connected Tino with our legal team, who contacted the college and reminded them of their obligation to conduct an individualized review rather than simply deny his request. Initially, the college stated that it was not able to locate a clinical site willing to accept a religious accommodation. However, after continued discussions, the college informed Tino that it was actively reviewing alternative placements.

Their efforts paid off. The college located an ambulance provider that accepted Tino's religious accommodation, allowing him to complete his required clinical ride-along and field training without compromising his sincerely held religious beliefs. Just weeks earlier, Tino had been told he might not be able to complete his EMT program. Today, he has successfully completed his required clinical training.

This case is another reminder that the first answer is not always the final answer. Schools may initially say there are no options, but different clinical partners often have different policies. With persistence, students may be able to complete their education without sacrificing their religious convictions.

Finding an appropriate placement can take time, so don't wait until the last minute. And if you encounter obstacles along the way, reach out to AVFCA. Many families are approached by attorneys or organizations that claim they can help in these situations, but often lack a full understanding of the applicable law or any demonstrated track record of success in clinical placement cases. In some instances, families are asked to pay significant legal fees without meaningful results.
