On Wednesday, August 26, Judge Brenda K. Sannes of the Northern District of New York held a conference with the parties' attorneys. After listening to brief arguments, Judge Sannes declined to grant a temporary restraining order before the motion hearing. Nonetheless, she granted an accelerated schedule for a preliminary injunction hearing over defense counsels' objection. The New York State Attorney General's Office must answer the plaintiffs' motion for a preliminary injunction by September 4. The plaintiffs must reply by September 9. A hearing will occur shortly thereafter. What's at stake: Can the kids with valid medical exemptions go to school? Can they participate in online school opportunities, where infection is a non-issue? Can NYS licensed physicians who write medical exemptions be trusted? Can school principals with no medical training override the directions of treating physicians?
