Last week, some major Supreme Court decisions were made which will have tremendous consequences for America.
For us, the takeaway is clear – many of the most consequential decisions that affect our country are made in the Supreme Court. People often think that elections only have consequences along the lines of who represents us in Congress or who the president is. But because Supreme Court Justices are nominated by the president and go through confirmation hearings and voting in the Senate, elections also have an impact on the people who make the most important legal decisions in the country.
While the Supreme Court reaffirmed last week what we already knew - birthright citizenship is as American as it gets, enshrined in the US Constitution, they also made decisions allowing wealthy elites to have even more power to buy elections and allowing states to discriminate against trans athletes.
Thankfully, the Supreme Court voted in a 5-4 decision to uphold the Fourteenth Amendment of the Constitution by protecting birthright citizenship in Trump v. Barbara . History will remember Donald Trump and MAGA Republicans for using hateful falsehoods and racist rhetoric to attack the Constitution in their efforts to divide and whitewash our country. Republicans may not like it, but America is a nation of diversity and opportunity.
While the Supreme Court stood up for the Constitution with their decision on birthright citizenship, the Court’s decisions in National Republican Senatorial Committee v. FEC and West Virginia v. B.P.J. and Little v. Hecox were major steps backwards for equity.
Corporations and the ultra-wealthy already have too much influence in elections, and the Court’s decision in National Republican Senatorial Committee v. FEC removing limits on coordinated campaign spending further dilutes the voice of everyday Americans in our elections. This is yet another example of national Republicans stacking the deck in favor of the wealthy at the expense of individual voters, worsening the terrible legacy of Citizens United .
In West Virginia v. B.P.J. and Little v. Hecox, the Court decided to allow states to ban trans individuals’ participation in sports. No doubt about it, Republicans scored a victory in their efforts to politicize youth sports and create an issue to divide people. This disgraceful decision came on the last day of Pride Month, and is an example of hurtful and hateful policies that are characteristic of the GOP’s platform of division and distraction. Thankfully in New Mexico, our Democratic leaders stand up for fair treatment for our trans neighbors, but unfortunately, this decision exposes trans Americans in red states to even more discrimination.

These SCOTUS decisions came just a day after two other incredibly important Supreme Court decisions. In Watson v. Republican National Committee , the Supreme Court disagreed with Trump's weak executive order to restrict some states' legal rights to conduct elections, allowing states to continue to accept mail-in ballots that are postmarked by the close of polls on Election Day. Once again, Trump's plans had nothing to do with making elections more secure, and everything to do with restricting Americans' ability to vote in order to give the GOP a dishonest advantage.
And in Trump v. Slaughter , the Court ruled 6-3 to give Trump sweeping authority to fire the heads of independent regulatory agencies like the FTC without cause. This is an alarming expansion of presidential power that rewards Trump’s attacks on separation of powers.
The Court also rejected Trump’s appeal of the 2023 civil verdict that found him liable for the sexual assault of E. Jean Carroll. This means that Trump still owes Carroll over $5 million for sexually abusing and defaming her, but unsurprisingly, Republicans are altogether quiet about this, not even willing to speak out against Trump when the Supreme Court holds him responsible for sexual assault.
Thankfully, Democrats in New Mexico are committed to protecting your rights, the importance of which is underscored by several of last week’s SCOTUS decisions. And with Senator Ben Ray Luján up for reelection this November, we have to make sure we do everything we can to return him to the Senate, to stand up against Trump and MAGA overreach.
