I’m excited to share a MAJOR update on our work to challenge the federal government’s repeated attempts to shrink—and ultimately dismantle—the social safety net. Earlier this year, NCLEJ sued the USDA over unlawful food restriction waivers that limit the types of food that can be purchased using Supplemental Nutrition Assistance Program (SNAP) benefits. While the government framed these waivers as a way to encourage SNAP recipients to eat more healthy foods, their failure to follow the law, including their own regulations, suggests otherwise.
Yesterday, in a massive victory for the millions of low-income people who rely on SNAP to stave off severe hunger and poverty, we prevailed in our lawsuit. The Court struck down these unlawful waivers in Colorado, Iowa, Nebraska, Tennessee, and West Virginia, putting an end to the waiver programs in those states and casting doubt on the validity of similar programs in other states around the country. Our story is now being covered in major national and local outlets across the United States.
This ruling couldn’t have come at a more critical time, as the Trump administration continues its war on poor and working-class people. Millions of people—including children, the elderly, and those living with disabilities—are being kicked off SNAP rolls due to stricter eligibility requirements and application processes, and the administration continues to peddle unfounded allegations of “fraud” as a pretext to further hollow out the program.
Through this litigation, we have sent a powerful message to the Trump administration that they cannot remake SNAP through administrative fiat. We fought back—and won.
