Judge: CMS Can't Share Medicaid Data With DHS While Parties Confer
On May 30, the U.S. District Court for the Northern District of California held a hearing in California v. HHS [[link removed]] . The judge clarified that in the short term, for the 22 plaintiff states, Medicaid data cannot be shared with DHS, and DHS can’t use Medicaid data it may already have for immigration enforcement. However, once the details of whose data can be shared is settled on by the parties, the judge will allow Medicaid data to be shared with DHS for immigration enforcement. The judge asked parties to define the scope of whose data CMS can share with DHS and set deadlines for the parties in June. He also scheduled a hearing in the event that the parties cannot agree on July 16, 2026. The judge also allowed confirmatory discovery to go forward with a similar timetable.
CMS Withholds Additional Medicaid Funds Alleging Fraud
CMS continues to withhold Medicaid funds based on fraud claims. Fox News [[link removed]] reported that CMS sent letters to five states: California, Florida, Maine, Minnesota and New York, alleging provider fraud. Dr. Oz told Fox News that he “suspects a lot of foreign governments are involved in the fraud schemes across the country targeting specific areas.” The Associated Press [[link removed]] reported that CMS deferred an additional $91 million in Medicaid funding to Minnesota due to new allegations of fraud. This deferral of funding is in addition to the funds the administration already withheld.
