Dear John,
We’re heading back to the U.S. Supreme Court! After IJ secured a major victory for a New Jersey family farm seeking access to an independent (i.e., a real) court, the federal government petitioned the justices. Now IJ will defend that win before the nation’s highest court.
Here’s the problem: Federal agencies like the Department of Labor operate their own in-house courts, where employees of those very agencies serve as investigator, prosecutor, judge, and jury. This system denies ordinary people and small businesses the basic protections of a real, impartial court—as guaranteed by Article III of the Constitution.
Back in 2015, Sun Valley Orchards and brothers Joe and Russell Marino were swept up in this unfair system. DOL imposed devastating half-million-dollar penalties on the farm, most of which stemmed from the consultant the brothers hired filling out complicated paperwork incorrectly.

The Marinos fought for years in administrative court before joining IJ to challenge the process itself.
Last year, the 3rd Circuit ruled in the brothers’ favor: DOL’s in-house courts violate the Constitution. Now, the Supreme Court will decide if our win at the 3rd Circuit stands.
