SHOULD FELONS GET THEIR GUNS BACK?

Last Sunday in Shreveport, Louisiana, a man killed eight children — seven of his own — in what police called an execution-style domestic shooting. The suspect had a prior weapons conviction from 2019. He still had a gun.

Federal law says a felony conviction costs you your gun rights. But that line is actively shifting. In November 2025, the Trump DOJ transferred gun rights restoration authority back to the Justice Department, bypassing a congressional ban that had been in place since 1992. Within months, nine people with prior domestic violence convictions had their rights restored. The DOJ now expects up to one million restoration applications annually.

Supporters say recidivism rates drop over time and a decades-old conviction shouldn't follow someone forever. Critics say the background check system already has gaps — 1.2 million purchase denials since 1998 are considered an undercount because states report records inconsistently.

The question is whether that should last forever.

A weapons conviction is one of the clearest signals the system has that someone poses a risk. Background checks exist for exactly this reason, and restoring gun rights to people with violent histories — through a DOJ process that bypasses Congress — is a workaround with a body count waiting to happen.

A nonviolent felony from 15 years ago shouldn't permanently strip someone of a constitutional right. Recidivism rates fall sharply over time, and a blanket lifetime ban treats everyone with a record as a permanent threat. The point of the justice system is rehabilitation — at some point, people who've served their time should get their rights back.
