Congress is about to vote on whether to renew one of the federal government's most controversial surveillance powers—Section 702 of the Foreign Intelligence Surveillance Act (FISA).

This dangerous bill has given the FBI and other agencies a backdoor to spy on Americans—without a warrant, without oversight, and without limits. And now, with AI advancing rapidly, the dangers are about to explode.

Color Of Change opposed this bill in 2024, and we continue to fight to stop any policies and practices that put Black people and our leaders in danger. But to stop it from passing, Congress needs to hear from all of us right now.

Section 702 is intended to make it easier for intelligence agencies to spy on foreign terrorists, allowing agencies to sweep phone calls, texts, and emails between people in the U.S. and those abroad. But in reality, what it means is that if you’re texting a friend or relative overseas, your words can end up in secret government databases. And once the government has this information, federal agents can perform backdoor searches, even on American citizens, without a warrant.

And they do. Intelligence agencies already perform more than 200,000 “backdoor” warrantless searches on Americans’ communications every year based on the thinnest of justifications — and sometimes with no justification at all.

This is not just a civil liberties issue. It is also a civil rights crisis. The government has performed these searches on Black Lives Matter protesters, members of Congress, campaign donors, and even a judge who reported civil rights violations to the FBI!

And as the Trump administration incorporates AI into its searches, the mistakes, false positives, and bias we already know exist in law enforcement will only accelerate. We MUST stop Congress from renewing this unconstitutional law and letting AI supercharge it.
