Donald Trump is trying to legislate by presidential edict. His goal: undermine Social Security.
Trump ordered his administration to draft an Executive Order that would bypass Congress and suspend payroll tax contributions, defunding Social Security and Medicare.
Trump is not a king. He can't snap his fingers and eliminate the funding stream for some of the most successful federal programs ever created in the history of this country. But that’s exactly what he’s trying to do. Just look at this Fox headline:
While Trump claims he has the “absolute right” to suspend payroll taxes, the U.S. Constitution makes clear he absolutely does not.1 Article I, Section 8 of the Constitution states only Congress has the “Power To lay and collect Taxes.”

Trump's obsession with the idea to end the Social Security payroll tax is a non-starter in Congress. Even Republican members of the Senate realize it helps absolutely zero jobless people and it jeopardizes Social Security by undermining the funding stream.
Not only would a payroll tax cut do nothing for those who are unemployed, it may provide yet another huge tax break for businesses. It’s up to us to make sure the American people understand Trump’s supposed tax cut is both unconstitutional and nothing more than another attack on Social Security and Medicare.
