If DHS tries to silence you, here's what to do.



Friend –

Imagine: you post a critical comment about the president on Facebook, or you share an Instagram post urging your friends to join you at a rally against ice kidnappings. Or you simply sign an online petition telling your member of Congress to protect our immigrant neighbors.

These are all actions that many of us frequently take online, often without a second thought.

Now imagine, as a result of your online activity, you receive an email notice from a big tech corporation that the Department of Homeland Security has issued a subpoena for all of your personal data. They give you a ticking clock – you have ten days to appeal the subpoena, or the company will be forced to turn over your information to DHS.

What would you do?

This is the exact situation that two of our clients here in Pennsylvania recently found themselves in.

But here's the good news: once we challenged the DHS subpoenas in court, DHS backed down immediately. DHS didn't need a judge to rule that its actions were unconstitutional and illegal. The agency knew from the start that they were in the wrong in subpoenaing this personal information.

Like so much of the Trump administration's actions, these unlawful subpoenas are meant to intimidate us out of our rights. But if our showdowns with DHS have shown us anything, it's that when we stand up together and lean on the Constitution, we win.
