The 73-page Albany Federal Court filing charges the state regulations that went into effect on Dec. 31, 2019, allow unqualified school principals to overrule medical professionals with direct knowledge of the students’ health issues — and then bar the kids from returning to classes.
The new regulations are unconstitutional and “place undue burdens on the availability of a medical exemption for deserving medically fragile students ... (giving) school principals, who do not generally have any medical or legal training, authority to overrule treating physicians,” the lawsuit alleged.
Kennedy, whose Children’s Health Defense is a co-plaintiff in the suit, described the current guidelines as “barbaric, wrong."
