CHD Holds Press Conference with Legal Team and Plaintiffs in NY Lawsuit About Denied Lawful Medical Exemptions to School Children

Attorneys Sujata Gibson, Michael H. Sussman, and the CHD legal team led by Robert F. Kennedy, Jr. and Mary Holland filed a class action lawsuit on July 24, 2020 in Federal Court challenging the constitutionality of New York State’s Department of Health regulations that allow school principals to overrule treating physicians on recommendations about medical exemptions to immunization.

This morning, the legal team and plaintiffs held a virtual press conference with hundreds of registered attendees to briefly discuss the case and answer questions.

When I was a boy, it was unthinkable that an American liberal would acquiesce to censorship. It was axiomatic that all the Nazi atrocities had begun with censorship and silencing of critics of government policies. Our civics teachers taught that the free flow of information—even inconvenient truths—was the lifeblood of democracy.

History will record that, in 2020, it was men who called themselves “liberal” who lead the clamor for censorship. Today the CEOs of Google, Facebook, and Amazon openly silence the tragic stories of American mothers of vaccine-injured children and all other unapproved criticism of pharmaceutical products.

Two-Tiered Medicine: Why Is Hydroxychloroquine Being Censored and Politicized?

In 2003, severe acute respiratory syndrome (SARS) induced a global panic—a dress rehearsal, as it were, for Covid-19 in 2020. Although SARS fatalities rapidly petered out, concerns about the potential for future spread of the SARS coronavirus (SARS-CoV) left doctors eager to identify effective drugs for treatment and prevention. In short order, researchers chronicled the likely “prophylactic and therapeutic advantage” of chloroquine (CQ) and continued to explore the antiviral potential of CQ and its more benign analog hydroxychloroquine (HCQ).

This ongoing body of research was clearly at the forefront of many doctors’ minds when SARS-CoV-2 surfaced this year. In April, surveys of physicians in the U.S. and around the world overwhelmingly responded they would prescribe CQ or HCQ to treat or prevent COVID-19 in a family member, and would take it themselves.

At this point, when countries using HCQ are displaying a Covid-19 mortality rate that is only one-tenth the mortality rate in countries where there is interference with this medication, such as the United States, it ought to be distressing that a propaganda war against a potentially life-saving medication is being waged for political purposes, not based on medical facts.

If you’re hoping the COVID-19 pandemic will go on forever, this post may disappoint you. And, I get it. We have gone frothing-at-the-mouth nuts over a slightly above-normal virulence virus, with a unique and obvious age-distribution pattern that should have made containment easy and panic completely unnecessary. And, if you’re living in the United States, like I am, you probably think my declaration that this pandemic is “over” to be somewhere between wishful thinking and incredibly premature, and I hear you, too, although forgive me if I’m not sure you’re the one thinking clearly, given some of the things I’ve recently read. I promise to support my assertion with data, and the wisdom of people far more expert than me who are having a harder time being heard in the present climate.
