For nearly 50 years, Section 401 successfully protected rivers, lakes, wetlands, and drinking water. Even President Trump, during his first term, publicly stated support for protecting clean water. Yet in 2020, his administration weakened these protections, limiting states’ and tribes’ authority. In 2023, the Biden administration restored this authority, reaffirming local control to safeguard water quality. Now, the EPA under the Trump administration is attempting to roll back Section 401 once again, making it easier for polluting industries to bypass states and tribes. This puts our water, public health, and the environment at risk. Your voice matters. The public comment period is open through 2:00 PM PT on February 17, 2026. We need Congress and the EPA to hear loud and clear that states and tribes must retain the power to protect clean water. |
