Division: Customer Service, Compliance, and Public Safety ("formerly Field Services and Public Safety") – Contractor Registration Program, Electrical Program, Elevator Program, Plumbers Program, and Factory Assembled Structures Program
Topic: Proposal (CR-102) – Public Safety Program Fee Increases (FY27)
Brief Description: The purpose of this rulemaking is to amend the fees for Contractor Registration, Electrical, Elevator, Factory Assembled Structures, and Plumber. The proposed amendments would increase fees by the fiscal growth factor of 6.51% for fiscal year 2027. This rulemaking also makes housekeeping changes to correct a $0.10 error in the electrical rules for the exam non-refundable fee. The fee increase is necessary to cover increased operating expenses for the Programs. The current fee levels are insufficient to cover current Program expenses.
L&I proposes to amend the fees in the following chapters:
* Chapter 296-46B WAC, Electrical safety standards, administration, and installation
* Chapter 296-96 WAC, Safety regulations and fees for all elevators, dumbwaiters, escalators and other conveyances
* Chapter 296-150C WAC, Commercial coaches
* Chapter 296-150F WAC, Factory-built housing and commercial structures
* Chapter 296-150I WAC, Manufactured and mobile home installation
* Chapter 296-150M WAC, Manufactured homes
* Chapter 296-150P WAC, Recreational park trailers
* Chapter 296-150R WAC, Recreational vehicles
* Chapter 296-150T WAC, Factory-built temporary worker housing structures
* Chapter 296-150V WAC, Conversion vendor units and medical units
* Chapter 296-200A WAC, Contractor certificate of registration renewals—Security—Insurance
* Chapter 296-400A WAC, Plumber certification rules

Division: Division of Labor Standards ("formerly Fraud Prevention and Labor Standards") - Employment Standards
Topic: Adoption (CR-103) – Coercion Based on Immigration Status (SSB 5104 Implementation)
Brief Description: The purpose of this rulemaking is to clarify new worker protections under Chapter 296-128 WAC to align with Substitute Senate Bill 5104 [ [link removed] ] (SSB 5104) concerning instances of immigration-related coercion in the workplace. Rulemaking is required to implement SSB 5104 to further define terms and requirements. SSB 5104 includes the following labor standards requirements for employers:
* Employers are prohibited from coercing employees based on immigration status. This includes implicit or explicit communication pertaining to the perceived immigration status of an employee or their family member to deter an employee from engaging in protected activities or exercising a right under Chapters 49.46, 49.12, 49.30, or 49.48 RCW.
* Employees may file a complaint with L&I within 180 days of the alleged coercive action.
SSB 5104 (Chapter 236, Laws of 2025) became effective July 1, 2025. Employers are subject to enforcement for violations based on the new law.

Division: Insurance Services - Health Services Analysis
Topic: Proposal (CR-102) – Reimbursement Policies: Physical Medicine
Brief Description: The purpose of this rulemaking is to update WAC 296-21-290, Physical medicine, under Chapter 296-21 WAC, Reimbursement policies: Psychiatric services, biofeedback, physical medicine. The proposed amendments will (1) add chiropractors and occupational therapists to the types of providers who may perform and be paid for physical medicine services; and (2) restructure the rule text for improved clarity, readability, and precision.
Making this change will bring the rule into alignment with current policy regarding occupational therapists, who may already perform physical medicine services for workers. It will also enable chiropractors to bill for physical medicine services beyond the context of being an attending provider on the claim.
