America First Legal Files U.S. Supreme Court Brief on Behalf of U.S. Senators and Representatives Supporting President Trump’s Executive Order on Birthright Citizenship



AFL, alongside outside counsel, filed a U.S. Supreme Court brief on behalf of twelve U.S. Senators and sixteen U.S. Representatives — led by Senator Ted Cruz and Representative Jim Jordan — backing President Trump’s executive order to protect the true meaning of American citizenship. The brief argues lower courts wrongly expanded birthright citizenship beyond the U.S. Constitution’s limits and ignored the Fourteenth Amendment’s requirement of lawful presence and allegiance. 


AFL’s brief makes clear that Supreme Court precedent applies only to children of legal residents, not those in the country illegally. It also emphasizes that citizenship policy belongs to Congress, not activist judges. President Trump’s order defends national sovereignty, restores the rule of law, and ensures U.S. citizenship remains tied to fidelity to the United States and its laws.


America First Legal and the State of Florida File Landmark Petition to Unleash American Energy Dominance and Lower Energy Prices for the American People



AFL has filed a major petition on behalf of the state of Florida and Last Energy, Inc., demanding that the Nuclear Regulatory Commission (NRC) stop its bureaucratic overreach and permit Florida and Last Energy to unleash American energy. The NRC is illegally blocking advanced, American-made nuclear reactors with costly red tape that goes beyond what the Atomic Energy Act allows.


Despite the NRC’s admission that Last Energy’s design meets safety goals, the NRC continues to overreach beyond its statutory authority and President Trump’s policy reforms that the NRC reduce regulations and promote innovation. As such, the NRC is impeding the unleashing of America’s energy abundance that will cut costs for American families. Florida is ready to lead in energy innovation, and AFL will continue to support Florida’s — and other states’ — right to restore state authority, strengthen energy independence, and put America First in nuclear power.


America First Legal Reveals States Lack Evidence in Lawsuit Challenging Trump Administration’s Ban on Taxpayer-Funded Chemical and Surgical Mutilation of Children



AFL revealed that states suing President Trump over Executive Order 14187 — which blocks taxpayer funding for the chemical and surgical “transition” of minors — cannot produce evidence of real harm. Fifteen left-wing states and the District of Columbia claimed the order would punish providers and damage youth mental health, but AFL’s records requests found no proof to back those allegations.


Health agencies in Massachusetts, Illinois, and Nevada all admitted they have no records showing prosecutions, penalties, clinic closures, or increased mental health crises tied to the order. Once again, blue-state officials are pushing politically motivated lawsuits instead of facts. AFL will continue defending the America First agenda and President Trump’s commonsense mission to protect children from irreversible medical abuse.


America First Legal Reveals Five States Lack Evidence in Lawsuit Over Trump Administration’s Federal Wind Regulation Review



AFL has again exposed the pattern of left-wing states suing President Trump to stop his lawful actions, despite the states lacking standing to do so. In this instance, multiple states sued the Trump Administration, challenging the findings in the administration’s Wind Memorandum, claiming that President Trump’s pause on federal wind leasing harms their environment, economy, and security.


However, AFL’s records requests revealed that some states cannot produce evidence of real harm and that these agencies have no data to support their accusations. Illinois, Maryland, Massachusetts, and Michigan all admitted they lack records proving increased pollution, economic damage, or safety risks. This confirms the lawsuits are political attacks, not serious legal claims, and AFL will continue to reveal politically motivated lawfare from activist states.


U.S. Environmental Protection Agency Moves to Rescind Biden-Era “Environmental Justice” Regulation Following America First Legal Petition



In December, after AFL uncovered that the Biden Administration had injected “environmental justice” as a basis to fast-track FOIA requests at the agency, AFL filed a petition for rulemaking to stop the Environmental Protection Agency’s (EPA) use of Biden’s “environmental justice–related need” rule. Under Biden, agencies bent the law by granting special treatment and fee waivers based on political preferences rather than FOIA’s specific, limited standards.


Last week, the EPA moved to end the Biden Administration’s misuse of “environmental justice” to fast-track FOIA requests. The EPA’s proposed rule restores neutrality, transparency, and equal treatment for all Americans under the law, a position AFL sought. This is a win against political manipulation and a step toward holding federal agencies accountable.
