SPRINGFIELD – The Illinois Department of Labor (IDOL) has filed a complaint in Cook County Circuit Court against That’s Gino and Marty’s, LLC, its management company White Glove Service and Management, LLC, and several individual owners and managers, alleging violations of the Illinois Wage Payment and Collection Act and the Illinois Minimum Wage Law.

The complaint alleges that from December 2023 through August 2025, employees at the restaurant located in Chicago’s West Loop were not paid some earned wages, including tips and gratuities, and that some workers were paid below the state’s minimum wage and were not properly compensated for overtime hours worked.

Following a preliminary investigation, IDOL determined that at least nine employees were collectively owed more than $20,000 in unpaid wages, with additional damages and statutory penalties sought under Illinois law. 

“Illinois law is clear: workers must be paid fully, fairly, and on time,” said Illinois Department of Labor Director Jane Flanagan. “When employers withhold earned wages, or ignore minimum wage and overtime requirements, the Department will use every tool available to recover wages owed and hold responsible parties accountable.”

The case was filed by the Office of the Illinois Attorney General on behalf of IDOL. The allegations outlined in the complaint are claims only and have not yet been adjudicated by the court.

Employees who believe they may be owed wages are encouraged to file a claim with IDOL.
