Days after taking office in 2025, Trump pardoned 23 people convicted under the FACE Act, many of whom were convicted for physically blocking patients from seeing their doctors and accessing needed care. Trump also directed the DOJ to stop prioritizing enforcement of the FACE Act—but only at abortion clinics.

The DOJ continues to selectively and politically enforce the FACE Act. Just last week, federal authorities arrested multiple people in connection with an anti-ICE protest at a Minnesota church, and are allegedly pursuing FACE Act charges—while refusing to do the same to protect abortion clinics.

We tried to get answers:

  • August 2025: We filed FACE Act FOIA #1.
  • October 2025: Documents were due; none were produced.
  • November 2025: We filed FACE Act FOIA #2.
  • January 2026: The DOJ missed its deadline again.
  • NOW: We're taking them to court.

The stakes are real. In 2023 and 2024 alone, abortion providers and patients nationwide faced 296 death threats or threats of harm, and 777 clinic obstruction incidents.

That's why our FOIA litigation is so urgent. We’re suing to uncover why abortion clinics are being excluded from protection, who made these decisions, and whose interests are driving DOJ policy.
