Today, the U.S. House of Representatives passed House Joint Resolution 140 (HJ Res 140) , Representative Pete Stauber's attempt to use the Congressional Review Act (CRA) in a totally unprecedented way - to overturn the 20-year mining ban protecting the Boundary Waters watershed from toxic copper mining.
Next, the resolution moves to the Senate, where, it would bypass filibuster and require only a simple majority to pass.
The CRA has never been used to challenge or overturn mineral withdrawals or Public Land Orders. These are governed by the Federal Land Policy and Management Act (FLPMA), and the proper process was followed completely and legally when the Boundary Waters mineral withdrawal was established in 2023.
This resolution doesn't just threaten the Boundary Waters — America's most visited Wilderness. It sets a dangerous precedent that any past land management decision or Public Land Orders could be vulnerable to being undone. We need you to help us fight back.
