House Bill 5363 – expands existing parental notice and opt-out protections when classroom instruction bill adds gender identity, gender expression, sexual orientation, sexual attraction, and consent as topics that trigger advance notice and opt-out rights.
Before a pupil may be enrolled in a class covering these areas, parents or legal guardians must be notified in advance, given the opportunity to review instructional materials, and informed of their right to excuse the pupil without penalty. House Bill 5364 – will require legislative approval before any revisions to the State Board of Education’s recommended model core academic curriculum content standards may be implemented or enforced. Revisions could not take place unless approved by a concurrent resolution adopted by both the House of Representatives and the Senate.
This change ensures that major education policy decisions affecting classrooms statewide are subject to public debate, recorded votes, and accountability to parents and taxpayers, while preserving full local school board control over curriculum decisions.
