This month, the Trump administration instituted a sweeping change to the U.S. postal system that has seriously impacted vote-by-mail laws. While vote-by-mail varies across states, most of them allow mail-in ballots to be counted past the day of the election if they are post-marked before ballots close.

This new USPS update for postmarking mail means that countless ballots delivered close to Election Day may be thrown out for the upcoming 2026 midterm elections.

Postmarking used to be defined by the date that a ballot was dropped off at the mailbox by the sender. However, this new rule defines postmarking by when the mail facility receives the ballot, creating a potential multi-day disconnect between when a ballot is sent and when it is processed.

This is one of several steps meant to curb, limit, and ultimately eliminate vote-by-mail. Two months ago, Karoline Leavitt and President Trump announced they would ramp up their efforts to dismantle vote-by-mail as a response to their party's poor performance in recent elections.

The administration continues to attack vote-by-mail through many novel avenues, including:

  • A Supreme Court case, Watson v. Republican National Committee, which is currently challenging the legality of accepting mail-in ballots past Election Day.
  • The Trump administration announced publicly that it is looking to use an executive order to directly attack vote-by-mail.
  • A website published by the White House continues to perpetuate the lie that mail-in ballots played a major role in the 2020 election being stolen.
  • Strict voter ID requirements for vote-by-mail ballots and restrictions on who is eligible to receive mail-in ballots and criminal penalties for ballot collecting.
  • Shorter deadlines on voter registration, and reduced quantities of dropboxes with restricted hours

These attacks on mail-in voting are part of a larger, coordinated effort to disenfranchise Americans from their most essential constitutional right.
