What’s at Stake: Supreme Court Cases That Could Reshape LGBTQ+ Rights
The week, the U.S. Supreme Court has heard cases that could have sweeping—and dangerous—implications for LGBTQ+ people nationwide.
At the center are challenges to state bans on transgender girls participating in school sports, where several justices appeared skeptical that these laws constitute sex discrimination. If upheld, these bans could do far more than sideline trans youth: they may open the door to invasive sex testing for girls, erode long-standing civil rights protections, and set a precedent that allows states to target transgender people under the guise of “fairness.”
The consequences of these rulings could ripple far beyond athletics, threatening hard-won protections across education, employment, and public life.
At the same time, extremist lawmakers are already signaling how far they’re willing to go if the Court continues to roll back LGBTQ+ rights. In Tennessee, Rep. Gino Bulso has introduced a slate of anti-LGBTQ bills explicitly aimed at challenging Supreme Court precedent, including Obergefell v. Hodges. His proposals seek to undermine marriage equality, weaken anti-discrimination protections, and ban Pride flags and symbols from state property; an alarming reminder that attacks on LGBTQ+ rights don’t stop at the courtroom door. The state has also passed an anti-drag bill this year.
