Families Sue New York State for Denying  Lawful Medical Exemptions to School Children

Attorneys Sujata Gibson, Michael H. Sussman, Robert F. Kennedy, Jr. and Mary Holland filed a class action lawsuit yesterday in the Northern District of New York challenging the constitutionality of New York State’s Department of Health regulations that allow school principals to overrule treating physicians on recommendations about medical exemptions to immunization for medically fragile kids.

The named plaintiffs, eight New York State families whose valid medical exemptions for their school children were denied, and Children’s Health Defense ask that the court declare the state policy unconstitutional and allow the children back into school.

If COVID Fatalities Were 90.2% Lower, How Would You Feel About Schools Reopening?

The CDC has instructed hospitals, medical examiners, coroners and physicians to collect and report COVID-19 data by significantly different standards than all other infectious diseases and causes of death. These new and unnecessary guidelines were instituted by the CDC in private, and without open discussion among qualified professionals that are free from conflicts of interest, and despite the existence of effective rules for data collection and reporting, successfully used for more than 17 years. As a result, elected officials have enacted many questionable policies.

The authors of this paper present significant evidence to support the position that if the CDC simply employed their 2003 industry standard for data collection and reporting, which has been successfully used nationwide for 17 years, the total fatalities attributed to COVID-19 would be reduced by an estimated 90.2%, and questions would be non-existent regarding schools reopening and whether or not Americans should be allowed to work.

A resolution to cease the buildout of 5G wireless infrastructure until it can be proven safe, through independent research and testing, passed the Hawaii County Council on July 22, 2020, almost unanimously. The vote was 8-1.

The resolution, introduced by council member Matt Kaneali’i-Kleinfelder, came to the table after months of daily emails and phone calls from constituents regarding 5G. “There was overwhelming public concern,” he said.

In May of 2020, New York Governor Andrew Cuomo announced that he had asked the Bill and Melinda Gates Foundation to help “reimagine” the New York Education System. He outlined some of the technology-based goals which on the surface sounded like noble goals, then questioned the need for school buildings.  

“The old model of everybody goes and sits in the classroom, and the teacher is in front of that classroom and teaches that class, and you do that all across the city, all across the state, all these buildings, all these physical classrooms — why, with all the technology you have?” Cuomo said.

The response from educators and others was swift and harsh.

Gain-of-function studies are, according to the U.S. Department Health and Human Services, research which involves increasing the capacity of a pathogen to cause illness. The method is controversial because it can also risk new viruses leaking out of laboratories and into the population. In the period 2014 to 2018 this type of research was prohibited in the U.S., but in December 2017, American authorities announced that these kinds of studies would again be allowed.
