Friend — your generosity is funding these successful legal battles. Thank you for making this work possible.
Dear Friend,

As we fight the Trump administration’s attacks on the environment, we are celebrating the victories you've helped us achieve.

This month, we are celebrating the rollout of electric USPS trucks, a landmark win for environmental justice in New Jersey, a case that stopped a dangerous floating methane plant in Louisiana, and the end of a costly gas-line rule in New York that put corporate profits ahead of ratepayers.

Your donations allow us to represent our clients free of charge. Together, we are building a more just, sustainable world. Thank you for making all of this possible!

Electric Postal Service Vehicles Deliver Holiday Cheer and Clean Air

Just in time for the holiday season, the U.S. Postal Service rolled out its first crop of zero-emissions mail trucks.

As of December, more than 2,600 electric vehicles were delivering mail in 65 locations around the country, including in California, Colorado, Georgia, Missouri, and New York. USPS launched these trucks as part of a commitment to electrify most of its new fleet, which followed sustained Earthjustice litigation and thousands of Americans writing to the Postal Service to advocate for this change.

Many letter carriers love the electric trucks, citing major upgrades like air conditioning, anti-lock brakes, and airbags. Best of all, the new vehicles mean cleaner air for the neighborhoods they operate in and a healthier climate overall.

As Earthjustice works to transition the country to 100% clean energy, we’re looking to shift everything on wheels to zero emissions models. These mail trucks are just the beginning.

New Jersey Appellate Court Affirms Environmental Justice Law

In a major win for environmental justice groups, a state appellate court gave the New Jersey Department of Environmental Protection the green light to implement its landmark environmental justice law.

The 2020 law was written to protect overburdened communities from further pollution, but it wasn’t until 2023 that New Jersey finalized rules that gave the law teeth.

Polluting industries quickly sought to strike down any meaningful implementation of the law. Earthjustice fought back, representing numerous environmental justice community organizations as friends of the court to support the law’s implementation.

This week’s ruling is a win for all New Jersey residents, but primarily for the environmental justice communities that have long championed this fight. When our environmental laws protect our most vulnerable communities, they protect us all.

Proposal for Floating Methane Gas Power Plant Defeated in Louisiana

Late last year, Entergy Louisiana gave up its quest to build a new methane gas power plant on a floating barge off the coast near Leeville, Louisiana. Earthjustice represented a local group, the Alliance for Affordable Energy, in opposing the proposed methane gas plant, which not only posed a threat to local communities, but would have been significantly more expensive than available alternatives.

The proposed 112 Megawatt Bayou Power Station would have included six methane gas units loaded on a barge and moored in a highly vulnerable area already suffering significant wetland losses. In addition to the initial project costs of $411 million, the annual operation and maintenance costs of the methane gas units and barge would have exceeded $5.8 million to serve less than 7,000 customers. Entergy failed to seek bids from more than one contractor. Cost overruns and construction delays seemed likely.

Earthjustice provided evidence that available transmission alternatives were both less expensive and would also provide more reliable and resilient delivery of electricity. Entergy is now evaluating transmission alternatives instead, as Earthjustice and our clients suggested in 2024.

New York Eliminates Costly Gas Line Rule After Years of Advocacy

Last month, the Renewable Heat Now campaign and allies across the state celebrated the repeal of the “100-foot rule,” an outdated, unfair policy that allows for-profit gas corporations to charge their customers hundreds of millions each year to expand fracked gas pipelines. According to recent analysis from the Public Utility Law Project, the 100-foot rule costs New Yorkers up to $600 million annually.

Utilities use policies such as the 100-foot rule to fund and profit from the expansion of fossil fuels, driving up energy costs for their customers. With her signature on the bill, Governor Hochul starts the process of removing these unnecessary charges from customers’ bills. Across the country, states are moving to end similar giveaways for gas utilities. California and Colorado have already eliminated their versions of the 100-foot rule, and Massachusetts and Maryland are making progress toward the same goal. Washington, Oregon, and Minnesota have begun or are considering similar phase-outs as well.

The onslaught of environmental attacks from polluting industries and their allies in the Trump administration is not slowing down – but neither is the pace of our litigation. Your contributions give us the resources to hold on to progress made through our victories and to keep fighting for a more just, sustainable world. Thank you.
