Categorical Exclusion Determination, Afton, WY, South Highway 89 Waterline Replacement Project
The Department of Environmental Quality/Water Quality Division (DEQ) has conducted a review of the proposed Town of Afton-South Highway 89 Waterline Replacement Project in accordance with EPA and State of Wyoming procedures for implementing the State Environmental Review Process. DEQ has determined that this project is eligible for a categorical exclusion. Accordingly, DEQ is exempting the project from further substantive environmental review requirements under the State Environmental Review Process. Neither an Environmental Assessment/Finding of No Significant Impact nor an Environmental Impact Statement/Record of Decision will be required for the proposed action. The following is a brief description of the situation and the proposed action and a brief statement of how the action meets the criteria for a categorical exclusion.
This waterline replacement project will update existing water lines along the US HWY 89 corridor from Highway 238 south to Papworth Lane. The route of the line follows the west side of US 89 for about 1,350 feet along the business frontage at which point it steps to the back lot line and continues south to Papworth Lane along the rear of the businesses. The new line will be 10-inch PVC installed in close proximity to the existing waterline. The estimated project cost is $2,047,000.
The Town intends to finance the project through a *Drinking Water State Revolving Fund (DWSRF)* loan. The Town has had the project listed on the Intended Usage Plan (IUP) for the 2026 Fiscal year. Because of this, the Town was selected for the project priority list (PPL) and offered a preliminary reserved funding package including a loan of $2,047,000 at a .75% interest rate with principal forgiveness of $914,572 (44.679%).The loan is proposed to be repaid over a *20-year term.* Based on existing and projected users, current cost estimates, and repayment terms, water service demand charges are projected to increase by approximately *$4.00 per month* per customer to cover debt service associated with the loan.
The Town of Afton is aware of and accepts the fact that they will be responsible for any required mitigative actions associated with and including storm water runoff, erosion control, archeological/historic artifacts, and air quality concerns. These will be part of the standard State Revolving Funds Program contract conditions.
DEQ is granting an exclusion because this project will be completely constructed in previously disturbed ground, specifically ground disturbed by installation of the existing waterline, roads, telephone, power and gas utilities. DEQ has determined that exempting the proposed project from further review under the State Environmental Review Process will not result in adverse impacts to the population or the area of the Town of Afton, Lincoln County, Wyoming.
The determination shall become effective upon distribution by the Department and may be re-evaluated and the determination changed at any time that adverse information is made available. The documentation to support this decision will be on file in the DEQ Cheyenne Office and is available for public review upon request. To request a copy of the categorical exclusion, contact:
