It’s been almost five years to the day since the January 6th insurrection shook our nation. For months, Trump spread dangerous lies about a “rigged” election.

Then, on January 6, 2021, insurrectionists stormed the U.S. Capitol at Donald Trump’s urging. Trump incited tens of thousands of his supporters to “fight like hell” to overturn the election results by marching to the Capitol to “stop the steal.” He even poured fuel on the fire, targeting Vice President Mike Pence for lacking the “courage” to overturn the election in a tweet that incited the mob to action.

Rather than acting to defend the Capitol, Trump continued urging members of Congress to advance the mob’s goal of delaying election certification. He swore an oath to the Constitution, and on January 6th, he violated it.

From the very beginning, it was clear CREW had to act. Anyone who took part in the insurrection had to be held accountable — even the president.

In the immediate aftermath of January 6th, CREW led the charge for Donald Trump’s impeachment. We committed to holding those responsible accountable and to never allowing a similar attack to happen again.

We launched a nationwide effort to hold January 6th insurrectionists accountable. We meticulously tracked corporate donations to the Sedition Caucus. We brought lawsuits under Section Three of the 14th Amendment to enforce the Constitution’s ban on insurrectionists holding office.

We even took Donald Trump to the Supreme Court for violating the 14th Amendment by inciting an insurrection after taking an oath to defend the Constitution.

John, at every turn, CREW has taken action to confront the danger Donald Trump poses to our democracy and to hold him accountable. But let’s not forget that while the Supreme Court declined to bar Trump from the ballot, it also did not dispute that he is an oath-breaking insurrectionist.

John, that’s because the evidence of his incitement was overwhelming. CREW presented extensive witness testimony and a detailed factual record, building on the constitutional argument we successfully used to remove Couy Griffin, a Cowboys for Trump co-founder, from office in New Mexico for his role in the January 6th attack.

We believed — and still believe — that the same constitutional standard applied to Donald Trump. But the Court chose not to confront Trump’s conduct. Instead, it ruled that states lack the authority to enforce Section Three of the 14th Amendment against federal candidates unless Congress acts.

That decision was a profound disappointment. At a critical moment, the Court failed to use the tools the Constitution provides to protect our democracy.

But our fight did not end there — and it hasn’t changed.

Since returning to the office, Donald Trump has made one thing unmistakably clear: he remains an active and ongoing threat to our democracy. He has doubled down on the same lawless behavior — rewarding political violence, excusing insurrection and signaling that loyalty to him matters more than the Constitution.
