** More Evidence that Fluoride Lowers IQ: Will the CDC Keep Ignoring It?
------------------------------------------------------------

At present, more Americans drink fluoridated water than in all other countries combined, and the CDC acknowledges no dangers of water fluoridation other than mentioning the risk of dental fluorosis, the first—and most visible—sign of fluoride toxicity.

There are dozens of studies outside the U.S., linking fluoride exposure to reduced IQ, but American media outlets have remained mostly silent. For some reason though, the latest study on fluoride’s IQ effects (published on August 19) has received more attention, perhaps because it appeared in one of the nation’s top pediatric journals, JAMA Pediatrics.

Funded, in part by the U.S. government, the Canada-based study indicates once again, that moms’ exposure to fluoride during pregnancy can result in lower IQ scores in their children.

** CHD Will Appeal

Update—NY Lawsuit to Stop the Repeal of Religious Exemptions
------------------------------------------------------------

On August 23^rd, Judge Denise Hartman issued a decision denying the preliminary injunction/stay sought on behalf of 26,000 children and their families affected by the repeal of vaccine religious exemptions. The Judge composed a 34-page opinion which [in summary] made the following critical points:
1. It was established that absent an injunction, there would be irreparable harm to the children and families involved.
2. The court did not feel the balance of equities tipped in our favor [a second factor to consider in deciding whether to grant a preliminary injunction] because, Her Honor reasoned, unvaccinated children pose a threat to others who cannot get vaccinations.
3. The court reasoned that there is no constitutional right to a religious exemption and that the legislature had neutral, not discriminatory, purposes which she found compelling, that is protecting public health.

With respect to Judge Hartman's decision, Attorney Michael H. Sussman issued the following statement:

“We will appeal the denial to the Third Department as promptly as possible. Supreme Court properly recognized the irreparable harm the legislative repeal and Her Honor's decision will cause for 26,000 children throughout the State. We will seek a hearing as promptly as possible as we do not agree with Supreme Court's logic and reasoning concerning the possibility of success on the merits or the balancing of equities. We believe both favor preserving the status quo until final judicial resolution. We remain confident in our arguments.”

** SB 276 Will Violate the Doctor-Patient Relationship by Eliminating Medical Exemptions
------------------------------------------------------------

Op-Ed to California Globe by Mary Holland, Esq., Children's Health Defense Board Member

UC Berkeley Law Dean Erwin Chemerinsky recently weighed in on this in his OpEd, “Vaccines Protect Us. But does the U.S. Constitution protect anti-vaccine parents?,” published in the SacBee on May 6, 2019. Re-litigating SB 277, Chemerinsky got it wrong.

While it is true that under SB 277 there are no lawful rights for parents to refuse vaccination other than medical ones, what Chemerinsky didn’t articulate is that this new bill is about physicians, not parents. After SB 277, it is solely within a physician’s discretion to grant a medical exemption, based on past adverse reactions and family history. SB 276 ([link removed]) now seeks to remove a doctors’ ability to grant medical exemptions for the extremely small percentage that need them and, instead, to vest that authority in government bureaucrats.
