Commerce to initiate rulemaking to establish brief adjudicative proceeding for Growth Management Act

The Washington State Department of Commerce is exploring an update for the administrative rules for the Growth Management Act (GMA). A CR-101, intent for rulemaking, was filed on Dec. 24, 2025.

This rulemaking is exploring the establishment of a brief adjudicative proceeding for jurisdictions to appeal determinations made by Commerce concerning the GMA.

Commerce must make determinations such as whether certain jurisdictions meet the criteria for extensions concerning implementation of density requirements under RCW 36.70A.637 and RCW 36.70A.638, and for certification of parking studies under RCW 36.70A.681 and empirical parking studies under RCW 36.70A.635.

However, Commerce does not currently have an established process for jurisdictions that wish to appeal such determinations. The brief adjudicative proceeding could provide a mechanism for expedient appeals of determinations made concerning the GMA.

What's next?

Commerce will draft a process within WAC 365-199 and seek review of the draft rules through public comment and public hearing. Additional materials will be posted on the Commerce rulemaking webpage as they become available.
